Whether a Visitor, Client or a Professional, our primary goal is to provide you with exceptional WelcomeYears Services, and we understand that you may have questions or concerns regarding your personal information and how it will be used. Unless the context requires otherwise, all capitalized terms used, but not otherwise defined herein, shall have the meanings set forth in the Terms of Service which is located on the home page of our Website.
APPLICABILITY OF PRIVACY POLICY
This Privacy Policy applies to all information we collect when you use WelcomeYears; start a home assessment with us; contact us; or use the WelcomeYears Services directly or through the website of one of our partners (“Partners”). When you are no longer a Visitor or User, we may continue to share your information as described in this policy.
Throughout this policy, we use the term “personal information” to describe information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular person or household.

Personal information does not include de-identified or aggregate personal information or information that is lawfully made available from federal, state, or local government records.
Personal information is not considered to have been disclosed when you instruct a business to transfer your personal information from one business to another in the context of switching services.
By using the WelcomeYears Services, Visitors and Users agree to the practices described in this Privacy Policy.
1. PERSONAL DATA WE COLLECT
Personal Data You Provide: We collect personal information when a Visitor uses the WelcomeYears Services or link your bank account, debit card, or credit card to the WelcomeYears Service. The personal information collected during these interactions may include, but is not limited to, name, physical address, email address, phone number, bank account, debit card, or credit card number, biometric data, your photograph, the photograph of your passport or driver’s license or national identity document, any personal information that you provide relative to any Assessment Service (e.g., descriptions about your home, and Homeowner Photos) and a log of the Home Assessment Service you utilize through the WelcomeYears Service. We may need to collect additional personal information, such as your street address and zip code to fulfill our obligations related to providing the WelcomeYears Service to you. In addition, we may collect your location information. You are responsible for the accuracy of the personal information you provide to us and you will be responsible for the consequences of providing false or inaccurate information.
Personal Data We Collect Through Our Social Media Pages: We have pages on social media sites like Facebook, Instagram, and Twitter (“Social Media Pages”). When you interact with our Social Media Pages, we will collect personal information that you elect to provide to us, such as your contact details. In addition, the companies that host our Social Media Pages may provide us with aggregate information and analytics regarding the use of our Social Media Pages. See the “Analytics” section below to learn more about analytics.
Personal Data We Receive Automatically from Your Use of the Service: When you visit, use and interact with the WelcomeYears Service, we may receive certain information about your visit, use or interactions. For example, we may monitor the number of people that visit the WelcomeYears Service, peak hours of visits, which page(s) are visited, the domains our visitors come from (e.g., google.com, yahoo.com, etc.), and which browsers people use to access the WelcomeYears Service (e.g., Firefox, Microsoft Internet Explorer, etc.), broad geographical information, and navigation pattern. In particular, the following information is created and automatically logged in our systems:

Pixel Tags/Web Beacons: A pixel tag (also known as a web beacon) is a piece of code embedded in the WelcomeYears Service that collects information about engagement on the WelcomeYears Service. The use of a pixel tag allows us to record, for example, that a Visitor or User has visited a particular web page or clicked on a particular advertisement. We may also include web beacons in emails to understand whether messages have been opened, acted on, or forwarded; and

Referrals. If you provide us with contact information (including emails) of any friends we may contact those friends and say you have referred us to them. We may also receive information about you from your friends, if they provide us information about you. You should not give us any contact information for anyone unless you have their permission to do so. You may only provide us contact information for actual people you know who live in the United States and are 16 or older.
Online Tracking and Do Not Track Signals: We, our Service Providers (as hereinafter defined), Vendors (as hereinafter defined), and Partners may use cookies or other tracking technologies to collect information about your browsing activities over time and across different websites following your use of the Website. Our Website currently does not respond to “Do Not Track” (“DNT”) signals and operates as described in this Privacy Policy whether or not a DNT signal is received. To process your financial information and other payment methods in order for: (1) Client’s to pay for WelcomeYears Services and (2) Professionals to pay the applicable Revenue Share due WelcomeYears;

To develop new products and services;

To prevent fraud, criminal activity, or misuses of the WelcomeYears Service, and to ensure the security of our IT systems, architecture and networks; and

Aggregated Information. We may aggregate personal information and use the aggregated information to analyze the effectiveness of the WelcomeYears Service, to improve and add features to the WelcomeYears Service, and for other similar purposes. In addition, from time to time, we may analyze the general behavior and characteristics of Visitors or Users of the WelcomeYears Service and share aggregated information like general Visitor or User statistics with prospective business partners. We may collect aggregated information through features of the software that supports the WelcomeYears Service, through cookies, and through other means described in this Privacy Policy.
Marketing. We may contact you to tell you about WelcomeYears Services we believe will be of interest to you. For instance, if you elect to provide your email or telephone number, we may use that information to send you special offers. You may opt out of receiving emails by following the instructions contained in each promotional email or text message we send you. Users can also control the marketing emails and/or text messages you receive by updating your settings through your WelcomeYears Account. In addition, if at any time you do not wish to receive future marketing communications, please contact us at privacy@welcomeyears.com. If you unsubscribe from our marketing lists, you will no longer receive marketing communications but we will continue to contact you regarding our Website and the WelcomeYears Services and to respond to your requests.
Research and Development. We may use your personal information for testing, research, analysis, and product development, including to develop and improve our Service, products, and services and to create new products and services. We may anonymize and aggregate data collected through the Service by removing information that makes the data personally identifiable to you, which we may use or share for any purpose, including for marketing purposes and to analyze and improve the Service.
3. SHARING AND DISCLOSURE OF PERSONAL DATA
In addition to sharing your personal information with our Partners, in certain circumstances we may share your personal information with third-parties without further notice to you, unless required by the law, as set forth below:

Vendors and Service Providers: To assist us in meeting business operations needs and to perform certain WelcomeYears Services and functions, we may share personal information with vendors (“Vendors”) and service providers (“Service Providers”), including providers of hosting services, cloud services and other information technology services providers, email communication software and email newsletter services, advertising and marketing services, financial service providers (including Payment Processors, banks, and API services) customer relationship management and customer support services, and web analytics services (for more details on the third parties that place cookies through the Website, please see the “Cookies” section above). Pursuant to our instructions, these parties will access, process or store personal information in the course of performing their duties to us. We take commercially reasonable steps to ensure our Vendors and Service Providers adhere to the security standards we apply to your personal information.

CAPS Professionals and/or Clients: We share personal information between Designers and Clients who connect via the Service.

Merchant Partners: We may share personal information relative to your purchase of a Product Package with the Merchant Partner associated with that Product Package.

Advertising Partners: We may share your personal information with third-party advertising partners. Through the WelcomeYears Services, WelcomeYears may allow third party advertising partners to set Technologies and other tracking tools to collect information regarding your activities and your device (e.g., your IP address, page(s) visited, time of day). We may also combine and share such information and other information (such as demographic information and past purchase history) with third party advertising partners. These advertising partners may use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit third party websites within their networks. This practice is commonly referred to as “interest-based advertising” or “online behavioral advertising.” We may allow access to other data collected by the Website and the WelcomeYears Services to share information that may be useful, relevant, valuable, or otherwise of interest to you. International Data Transfer: Your personal data collected through the WelcomeYear Service may be transferred for the purposes described above to Partners, Vendors or Service Providers located in other countries. These countries may not have the same data protection regulations as in your state. In this regard, we inform you that we have implemented safeguards that guarantee an adequate level of protection of personal data when they are transferred to other jurisdictions. These safeguards include contractual clauses or commitments aimed at imposing compliance with the applicable and its complementary regulations. In any event, when using the WelcomeYears Services you are aware of the international transfer of your personal data as indicated in this section.

Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of the WelcomeYears Service to another provider, your personal information and other information may be shared in the diligence process with counterparties and others assisting with the transaction and transferred to a successor or affiliate as part of that transaction along with other assets.

Friends or Colleagues: WelcomeYears allows you to provide information about your friends and colleagues through our Refer-A-Friend Program. Our Refer-A-Friend Program may allow you to forward or share certain content with a friend or colleague, such as an email inviting your friend to use the WelcomeYears Services. Email addresses that you may provide for a friend or colleague will be used to send your friend or colleague the content or link you request, but will not be collected or otherwise used by WelcomeYears or any other third party for any other purpose.

4. DATA RETENTION

5. UPDATE YOUR INFORMATION
Users, please log in to your WelcomeYears Account if you need to change or correct your personal information. Additionally, both Visitors and Users can email us at privacy@welcomeyears.com to request that we correct any inaccurate personal information about you.
6. CHILDREN
The WelcomeYears Service is not directed to children who are under the age of 18. WelcomeYears does not knowingly collect personal information from children under the age of 18. If you have reason to believe that a child under the age of 18 has provided personal information to WelcomeYeaers through the WelcomeYears Service, please contact us at privacy@welcomeyears.com and we will endeavor to delete that information from our databases.
7. LINKS TO OTHER WEBSITES AND SOFTWARE DEVELOPMENT KITS
The WelcomeYears Service may contain links to Partner websites, and other websites not operated or controlled by WelcomeYears, including social media services (“Third-Party Sites”). The information that you share with Third-Party Sites will be governed by the specific privacy policies and terms of service of the Third-Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third-Party Sites directly for information on their privacy practices and policies.
We may use third party applications programming interfaces (“APIs”) and software development kits (“SDKs”) as part of the functionality of the WelcomeYears Service. APIs and SDKs may allow third parties including advertising partners to collect your personal information to provide content that is more relevant to you.
8. SECURITY
You use the WelcomeYears Service at your own risk. We implement reasonable technical, administrative, and organizational measures to protect personal information both online and offline from loss, misuse, and unauthorized access, disclosure, alteration or destruction. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the WelcomeYears Service or e-mail. Please keep this in mind when disclosing any personal information to WelcomeYears via the Internet. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the WelcomeYears Service, or Partner or third-party websites.
By using the WelcomeYears Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the WelcomeYears Services. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the WelcomeYears Services, by mail or by sending an e-mail to you.

In certain circumstances providing personal information is optional. However, if you choose not to provide personal information that is needed to use some features of the WelcomeYears Services, you may be unable to use those features.

When we do, we will post an updated version on this page on our Website, unless another type of notice is required by the applicable law. 11. CALIFORNIA-SPECIFIC CONSUMER PRIVACY PROTECTIONS
We currently do not meet the threshold requirements obligating our compliance with the California Consumer Privacy Act of 2018, as revised by the California Privacy Rights Act of 2020, and the associated regulations (“CCPA/CPRA”) and other California Laws. If we do so in the future, we will describe the privacy rights to which you would be entitled as a consumer under the CCPA/CPRA in this Privacy Policy.
